Alberta and British Columbia have their own private-sector privacy laws, and they apply to business AI use in those provinces alongside PIPEDA. Here is how they fit.

Two provincial privacy laws

Alberta’s Personal Information Protection Act (PIPA) and BC’s PIPA have both been in force since 2004 and are recognized as ‘substantially similar’ to PIPEDA — so organizations subject to them are generally exempt from PIPEDA for activity within that province (PIPEDA still governs interprovincial and international flows and federally regulated businesses).

What that means for AI

AI processing of personal information in Alberta or BC follows the applicable provincial PIPA’s consent, safeguard and accountability rules. Both laws exempt business contact information, and both are under modernization review — so watch for changes.

BC public-sector residency

Note BC’s separate public-sector law (FOIPPA): its blanket keep-in-Canada rule was relaxed in 2021 to a risk-based model requiring a privacy impact assessment for sensitive data stored outside Canada. osFoundry’s managed cloud pins data to US, EU or Japan — it does not currently offer a Canadian managed region. For data that must stay in Canada, the honest path is self-hosting osFoundry (BYO Cloud) inside a Canadian cloud region such as AWS Canada (Montréal/Calgary), Azure (Toronto/Quebec City) or Google Cloud (Montréal), or running models locally on-device.
